Immigration Appeals from Outside the UK

If you are not in the UK and have made a visa application that has been refused, you will have 28 days from the date of receipt to appeal this decision. You must lodge the appeal within the specified time frame. However, you can only make an appeal if you have a right to appeal. If you do not have a right of appeal, you may be able to challenge the decision by administrative or judicial review.

Immigration Appeals from within the UK

If you have had a visa application refused and you are in the UK, depending on the circumstances, you will normally have 10 working days to lodge your appeal with the Tribunal. You can only make an appeal where you have a right to appeal, however given the short timescale you should seek legal advice as soon as you receive the refusal if you intend to appeal. If you do not have a right of appeal, you may be able to challenge the decision by administrative or judicial review.

You may be able to make an appeal to the First-tier Tribunal (Immigration and Asylum Chamber) in a number of circumstances including where the Home Office has:

  • Refused your asylum or human rights claim.
  • Made a decision to deport you or refused to issue you a residence document under the European Economic Area (EEA) Regulations.
  • Made a decision to revoke your protection status.
  • Made a decision to take away your British citizenship.
